
Judge Anthony Kelly has dramatically overturned the decision by Australian government to revoke Djokovic Novak’s Visa and has ordered the release of tennis star from deetention and also ordered the government to pay his costs.
Judge Anthony Kelly oredered on monday that Djokovic be released with in 30 minutes and his passport and other travel documents be returned to him.
Although the federal judge released him, immigration minister has a right to overide the Court’s decision and again concel his visa which would see him banned from entering Australia for three years.
If the immigration minister revokes Djokovic’s visa again, he will face deportation and he could miss the Australian open which starts on january 17.
The dreama unfolded when Djokovic’s visa was cancelled after he arrived in Melbourne late Wednesday to play in the Australian open because officials decided he didn’t meet the crateria for an examption to an entry requirement that all non- citizens be fully vaccinated for Covid-19.
Djokvic was infected with covid-19 last month which meant he didn’t need proof of vaccination to enter Australia. A ustralian medical authorities had ruled that a temporary exemption for vaccination rule can be provided to people who have been infected with covid-19 with in six months.
Judge Anthony Kelly asked ” what more could this man have done” after he noted that Djokovic had provided officials at Melbourne’s airport with a medicial exemption given to him by Tennis Australia, which is organising the Tournament and two medical panels.
Djokovic’s lawyer described the cancellation as seriously illogical, irrational and legally unreasonable. There was also no evidence that Djokovic had acute major medical illness in December when he tested positive according to written submission.
This case of giving the world best tennis player visa by Australia to attend the Australian open tennis tournment only to be cancelled upon arrival has seriously undermined the credibility of Australian government in international community.
